29 CFR  OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to vehicle rollover crushing and unrestrained occupant ejection:  a)On September 9, 2020 located at the Paint Creek Lake Emergency Overflow Spillway Concrete Rehabilitation projects nonpublic single lane dirt/gravel project access road which showed signs of erosion from the Emergency Overflow area extending around a steep curve downhill to the lower level drainage area, employee(s) performing vehicle access road uphill and downhill travel from within a GMC 2500 4x4 Crew Cab Pick pickup truck were exposed to potential vehicle rollover crushing and unrestrained occupant ejection hazards associated with a vehicle overrunning the approximate 24 foot vertical line of fall road edge's unprotected steep embankment drop-off.   Among other methods one feasible and acceptable method to correct this hazard would be to:  Follow DEPARTMENT OF THE ARMY EM 385-1-1, U.S. Army Corps of Engineers Manual No. 385-1-1 30 November 2014:   Section 18. B.09: Seat belts and anchorages meeting the requirements of 49 CFR 571 shall be installed and worn in all motor vehicles (installation and usage on buses is optional).  Follow A&H Ambica JV, LLC Company Policy:  Chapter 5.1 Safety: It is the policy of the Company to comply with all applicable federal, state, and local health and safety regulations including but not limited to EM 385-1-1, OSHA 29 CFR Part 1926, Part 1910, Parts 1915, 1917 and 1918 as applicable.  Chapter 7.6.3 AUTOMOBILE USEAGE   (JUNE, 2016):  Employees who drive a vehicle on Company business must, in addition to meeting the approval requirements above, exercise due diligence to drive safely and to maintain the security of the vehicle and its contents. These include but not limited to wearing a seat belt all the time while in vehicle, checking for common functions of the vehicle before starting a vehicle including brakes, windshield wipers, mirrors, tire pressures and other parameters.
