29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Jobsite: On or about September 11, 2020, 4 employees were replacing an asphalt shingle roof on a residential home and they were either not protected from falling to the ground or were improperly tied off. The pitch of the roof was 10 in 12 and the fall hazard to the employees was about 25 feet to the ground.

29 CFR 1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employees knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill. (a) Jobsite: On or about September 11, 2020, the 4 employees that were replacing an asphalt shingle roof need to retrained on when and how to properly use fall protection when working from a roof.
