29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  On or about September 9, 2020, inside a structure under construction located at 1420 West 23rd Street in Miami, Florida, employees were exposed to fall hazards associated with performing site cleaning and supervisory work prior to the employer providing an inspection of the worksite by a competent person to recognize potential hazards and determine the proper materials and/or equipment needed to perform the work safely.

29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:  On or about September 9, 2020, inside a structure under construction located at 1420 West 23rd Street in Miami, Florida, employees were exposed to a fall hazard of approximately 8 - feet, 6 - inches when working near a wall opening leading to an elevator shaft while not being protected from falling into the shaft after opening an unlocked and/or secured door in front of the shaft opening.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On site of a structure under construction located at 1420 West 23rd Street in Miami, Florida, employees were exposed to fall hazards when performing site cleaning and supervisory work prior to being provided with a training program that would enable them to recognize the hazards associated with falling.
