29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a)Rapid Construction LLC at 6812 Wedgewood Court, Rapid City, SD 577702: On or about and at times prior to September 16, 2020, the employer did not ensure that employees conducting work in an excavation were protected from cave-in hazards. Employees were installing a new city water main in an excavation that varied in depth from approximately seven feet to eight feet which lacked an adequate protective system, such as sloping, benching, or shielding system. This condition exposed employees to cave-in hazards within an excavation.

29 CFR 1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that posed a hazard by falling or rolling into excavations and protection was not provided by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a)Rapid Construction LLC at 6812 Wedgewood Court, Rapid City, SD 577702: On or about and at times prior to September 16, 2020, the employer did not ensure that employees conducting connection work in an excavation were protected from hazards associated with the spoil pile directly next to the trench edge. This condition exposed three employees to injuries associated with rock and debris falling into the excavation.
