29 CFR  1926.20(b)(1): The employer did not initiate and maintain such programs as may be nescessary to comply with the standards set forth in 29 CFR 1926 as evidenced by the violation(s) noted during the course of the inspection:   (a)  On or about September 15, 2020, and at times prior thereto, the employer had not sufficiently maintained an accident prevention program to address hazards to which the employees of subcontractors are exposed.  Hazards include but are not limited to numerous unprotected floor holes on the entire second floor level, lack of use of personal protective equipment when using power tools without safety glasses and exposure to overhead hazards without use of protective helmets, housekeeping not maintained with excessive debris throughout the walking working surfaces.  Note: Abatement certification IS required for this item.

29 CFR  1926.20(b)(2):Frequent and regular inspections of the job sites, materials, and equipment were not made by a competent person(s) designated by the employer:  (a)  On or about September 15, 2020, and at times prior thereto, the employer did not perform effective inspections of the job site as the controlling contractor.  Inspections to identify, correct and/or eliminate to which their employees and/or the employees of subcontractors were exposed.  Hazards include but are not limited to numerous unprotected floor holes on the entire second floor level, lack of use of personal protective equipment when using power tools without safety glasses and exposure to overhead hazards without use of protective helmets, housekeeping not maintained with excessive debris throughout the walking working surfaces. 29 CFR  1926.501(b)(4)(ii):  Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes by covers.  (a)  11th and Main Apartments:  On or about September 15, 2020, and at times prior thereto, the entire 2nd floor consisting of 21 apartments had open floor holes without covers to protect employees from tripping/stepping into the hazard.  Note: Abatement certification IS required this item.

All debris was not kept clear from work areas and passageways in and around buildings and other structures.  11th and Main Apartments:  On or about September 15, 2020, and at times before, during the course of construction, alteration, and/or repairs the work areas on the second floor passageways were not kept clear and free of debris.
