29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to items of this section: (a)Secure Enterprise Asset Management, Inc. at 3101 North 1st Avenue, Sioux Falls, SD 57104: On or about and at times prior to September 11, 2020, the employer did not establish clear and specific procedures to outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy regarding baling machinery. The energy control procedures related to the Marathon Heavy Duty Vertical Balers were not clear and specifically outlined to address lock-out/tag-out procedures de-energization involving breakers in the main electrical panel. The company had recently moved into a new facility and did not update specific procedures involving the vertical balers. This condition exposed the employees to the hazards of improper lockout procedures. Abatement Note: The procedures shall include but are not limited to the following: (1) A specific statement of the intended use of the procedures; (2) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy; (3) Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and (4) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.212(a)(1): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a)Secure Enterprise Asset Management, Inc. at 3101 North 1st Avenue, Sioux Falls, SD 57104: On or about and at times prior to September 11, 2020, the employer did not ensure employees were protected from amputation hazards associated with exposed pinch-points regarding a vertical baler. Employees were utilizing a large magnet to bypass the magnetic feed gate interlock on the Marathon Heavy Duty Vertical Baler to create plastic bales. In order to increase the weight of the plastic bales, the magnet was used to allow the feed gate to remain open and the platen to cycle while an employee added additional plastic computer components within the baler. This condition exposed employees to amputation hazards related to the point of operation or the platen and bypassing the interlocked feed gate. (b)Secure Enterprise Asset Management, Inc. at 3101 North 1st Avenue, Sioux Falls, SD 57104: On or about and at times prior to September 11, 2020, the employer did not ensure employees were protected from amputation hazards associated with exposed pinch-points regarding a vertical baler. The feed gate on the Marathon Heavy Duty Vertical Baler baler designated as the metal baler, had openings in the fabricated metal guard of approximately two to three inches. This condition exposed employees to amputation hazards related to the point of operation or the platen while creating metal bales. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

This condition exposed employees to crushing hazards. Abatement Note: A sign reading "DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER" or using other similar language would satisfy the requirement for a sign. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
