29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles:   a)  123 N Perry ST. Johnstown, NY- On or about September 11, 2020, workers were exposed to a eye hazard from flying particles while driving nails with hammers and operating pneumatic nail guns at approximately 120 psi without wearing eye protection.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 123 N Perry ST.  Johnstown, NY- On or about September 11, 2020, workers that the employer had operational control over where exposed to a fall hazard while conducting roofing operations on a residential two story building with no method of fall arrest or restraint protecting employees falling to the next lower level.
