29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Tucker House located at 1001 Wallace Street, Philadelphia, PA : a) On or about September 22, 2020, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear respirators such as N95 filtering facepiece Cardinal Health CatN95-ml, 3M 1860S and 3M 8210 while providing care to suspected and confirmed positive COVID-19 residents. b) On or about September 22, 2020, the employer did not provide medical evaluation to all employees required to wear respirators. The employer required employees to wear filtering facepiece respirators such as and 3M GB 2626-2006 KN95 while working in the green zone section (non-COVID-19 designated areas) of the facility.

29 CFR 1910.134(f)(2): Employees using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator or annually refitted: Tucker House Nursing and Rehabilitation located at 1001 Wallace Street, Philadelphia, PA: a) On or about September 22, 2020, the employer did not provide a fit test to all employees required to wear respirators. The employer required employees to wear respirators such as N95 filtering facepiece Cardinal Health CatN95-ml, 3M 1860S, 3M 8210 respirators to protect against SARS-CoV-2 virus while providing direct care to suspect and confirmed positive COVID-19 residents. b) On or about September 22, 2020, the employer did not provide a fit test to all employees required to wear respirators. The employer required employees to wear respirators such as an 3M GB 2626-2006 KN95 while working in the green zone section (non-COVID-19 designated areas) of the facility.
