29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a. Located at 5605 W Broad St in Columbus, Ohio: On or about August 6, 2020, employees were operating pneumatic nail guns to secure sheeting/decking and frame in the second floor of an apartment building without eye protection. Employees were thereby exposed to eye injuries due to being struck-by nails and/or flying particles. Palenque Power Construction LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1462355, citation number 1, item number 2, and was affirmed as a final order on May 5, 2020, with respect to a workplace located at 1930 Morning Song Road in Marysville, Ohio.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. Located at 5605 W Broad St. in Columbus, Ohio: On or about August 6, 2020, the employer did not ensure employees were protected from falls from the second story of the residential apartment building being erected. Employees were framing in the second story of the second part of the apartment building and working near unprotected sides and edges with no fall protection measures in use, thereby exposing employees to fall hazards of approximately 10 feet. b. Located at 5605 W Broad St. in Columbus, Ohio: On or about August 6, 2020, the employer did not ensure employees were protected from falls from the second story of the residential apartment building being erected.
