CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):        On or about September 17, 2020 and at times prior thereto, at a workplace located at 1707 Placid Oaks Court, Westlake, Texas; the employer did not provide training to forklift operators to ensure employees are competent to operate the truck safely. The employees were exposed to fall and rollover hazards.

29 CFR 1926.453(a)(2): Aerial lifts may be "field modified" for uses other than those intended by the manufacturer provided the modification has been certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969 and this section and to be at least as safe as the equipment was before modification;     On or about September 17, 2020 and at times prior thereto, at a workplace located at 1707 Placid Oaks Court, Westlake, Texas; the employer attached a non-approved front-end loader and allowed an employee to work from it without a fall protection exposing the employee to fall hazard.

29 CFR 1926.453(b)(2)(v): A body belt or harness was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.    On or about September 17, 2020 and at times prior thereto, at a workplace located at 1707 Placid Oaks Court, Westlake, Texas; an employee working from a non-approved forklift attachment was not provided fall protection. Employee was exposed to a fall hazard of approximately 10 feet to the ground below.
