29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a. On or about September, 23, 2020, at 822 Anclote Road, Tarpon Springs, FL. 34689, employees were operating forklifts with a frontend attachment-modification/addition, to lift/move concrete piles, during which the employer failed to ensure that the operators of the forklifts had received initial operator/mechanic training and/or had not been trained by an Experienced person; therefore exposing the operator and the employees/pedestrians in the work area/yard to a roll-over/crushed-by, and struck-by hazard.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval and Capacity, operation, and maintenance instruction plates, tags or decals of the powered industrial truck were not changed accordingly:  a. On or about September, 23, 2020, at 822 Anclote Road, Tarpon Springs, FL. 34689,  employees were operating a forklift without the use of an approved lifting attachment, but rather via utilization of Free rigging (direct attachment to or placement of rigging equipment; slings, shackles, rings, spreader bars etc. onto the tines of a powered industrial truck for a below-the-tines lift) to lift/move concrete piles, during which the employer failed to obtain prior written approval from a qualified registered professional engineer or from the forklift manufacturer for the use of the modification/addition, nor were the trucks durable corrosion resistant capacity, operation, and maintenance instruction plates, tags, and decals changed as required; therefore exposing the operator and the employee on the elevating platform and employees in the work area to a load stability/roll-over and subsequent crush-by, fall and struck-by hazard.
