29 CFR 1926.651(h)(1): Employees were working in excavations in which there is accumulated water, or in excavations in which water is accumulating, adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: (a) This violation occurred on or about September 16, 2020, at the job site located at 8651 FM 1390, Scurry, TX, trench block E3; where employees were using a Vermeer Vac-tron, LP 573XDT, 113828 hydro vac truck with a pressure wand to remove mud from the trench and into a sump hole. Employees were exposed to a cave-in hazard.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection were not conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections were not made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated: (a) This violation occurred on or about September 16, 2020, at the job site located at 8651 FM 1390, Scurry, TX, trench block E3; where employees were working inside a trench that had not been inspected by a competent person for hazardous conditions.
