29 CFR 1926.20(b)(1): A safety program was not developed and/or maintained to provide compliance with the general safety and health provisions of the standard:  (a)T&R Contracting, Inc. at Intersection of Marion Road and Madison Street, Sioux Falls, SD 57106: On or about and at times prior to August 18, 2020, the exposing employer had not developed a safety and health program when employees were exposed to such hazards as electrical burns, shock and electrocution hazards related to the use of conductive tools around an energized medium voltage distribution line. This condition exposed employees to struck-by hazards, concrete placement hazards, and electrical hazards.   Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").  Abatement Note: A complete safety and health program includes the following elements:  (1)	Management Commitment and Leadership  (a)	Policy Statement: goals established, issued, and communicated to employees.  (b)	Program reviewed annually.  (c)	Participation in safety meetings, inspections; agenda item in meetings.  (d)	Safety rules and procedures incorporated into site operations.  (2)	Assignment of responsibility  (a)	Safety designee on site, knowledgeable and accountable.  (b)	Supervisor's (including foremen) safety and health responsibilities understood.  (c)	Employee adherence to safety rules.  (3)	Identification and Control of Hazards  (a)	Periodic site inspection program involving supervisors.  (b)	Preventative controls in place (PPE, maintenance, engineering controls).  (c)	Action taken to address hazards.  (d)	Safety committee, where appropriate.  (e)	Technical reference materials available.  (4)	Training and Education  (a)	Supervisors receive basic safety and health training.  (b)	Specialized training taken when needed.  (c)	Existence of an employee training program, which is ongoing and effective.  (5)	Recordkeeping and Hazard Analysis  (a)	Records maintained of employee illnesses/injuries and posted.  (b)	Supervisors perform accident investigations, determine causes, propose, corrective action.  (6)	First Aid and Medical Assistance  (a)	First aid supplies and medical services available.  (b)	Employees informed of medical results. 29 CFR  1926.702(h): Bull float handles were used where they might contact energized electrical conductors, and were not constructed of nonconductive material or insulated with a nonconductive sheath whose electrical and mechanical characteristics provide the equivalent protection of a handle constructed of nonconductive material:  (a)T&R Contracting, Inc. at Intersection of Marion Road and Madison Street, Sioux Falls, SD 57106: On or about and at times prior to August 18, 2020, the exposing employer did not ensure that bull float handles, used where they might contact energized electrical conductors, were constructed of nonconductive material.  An employee was utilizing a bull float or straight edge with a 30-foot long aluminum handle to finish concrete on Marion Road.  The overhead power lines were located approximately 20 feet above the employee. This condition exposed an employee to 19.9kV phase to ground  and the hazards of electrical burns, shock and electrocution and resulted in one employee being hospitalized after receiving an electrical shock when the bull float handle contacted an overhead power line. 29 CFR  1926.416(a)(1): An employee was permitted to work in proximity to an electric power circuit that the employee could contact in the course of work and was not protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means:  (a)T&R Contracting, Inc. at Intersection of Marion Road and Madison Street, Sioux Falls, SD 57106: On or about and at times prior to August 18, 2020, the exposing employer did not ensure employees were protected from electrical hazards while working in proximity to a 19.9kV phase to ground electrical distribution line. On August 18, 2020, an employee was severely shocked and burned as a result of using a concrete bull float or straight edge with a 30-foot handle to finish concrete on Marion street. During the process of using the bull float or straight edge, the employee lifted the handle high enough to contact a distribution line located above the work area. This condition exposed an employee to electrical burns, shock and electrocution hazards. 29 CFR 1926.20(b)(2):  The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)T&R Contracting, Inc. at Intersection of Marion Road and Madison Street, Sioux Falls, SD 57106: On or about and at times prior to August 18, 2020, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employee were exposed to struck-by hazards involving paving machinery, hazards related to concrete placement, and electrical hazards.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.  T&R Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard  29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1231262, citation number 1, item number 3, and was affirmed as a final order on October 5, 2017, with respect to a workplace located at I-29 Bridge/Tea SD Exit, Tea, SD 57064.
