29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. On or about September 24, 2020, on the west side of the project site; employees were operating a Genie Z45/25 aerial lift (#Z71223) without the use of a body belt as a tethering / restraint system while performing metal roofing installation work on the exterior of the building at heights upwards of twenty-five (25) feet.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about September 24, 2020, on the west side of the project site; an employee was on top of a fabricated metal roof without proper fall protection while performing metal roofing installation work on the exterior of the building at heights upwards of twenty-five (25) feet.
