29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about September 28, 2020, the employer did not ensure that each employee(s) engaged in residential construction activities 6 feet or more above lower levels were protected by guardrails, safety nets, or personal fall arrest systems. Employees of Silva Construction, LLC, were exposed to fall hazards greater than 11 feet, while engaged in residential framing activities. Employees were not using fall protection equipment. An employee of Silva Construction, LLC, was observed operating a GEHL- Dynalift forklift, the worker had not been trained or evaluated on forklift operations. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:   (a) On or about September 28, 2020, the employer did not ensure that portable ladders, used to access upper landing surfaces, extended at least 3 feet above the upper landing surface to which the ladders were used to gain access. Employees of Silva Construction, LLC, were observed descending a ladder from the top plate of a residential building. The ladder did not extend at least 3 ft above the landing platform and was not secured at the top.
