OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were working in close proximity to each other and customers, potentially exposing them to the hazard of SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease. a) On or about September 10, 2020, and continuing thereafter, the employer did not develop and implement timely and effective measures to mitigate the spread of SARS-CoV-2, the virus that causes Coronavirus Disease 2019 (COVID-19). The employee working at 3700 Government Blvd #E Mobile, AL works in close proximity to the owner and customers during the COVID-19 pandemic. Among other methods, a feasible and acceptable means of abatement would be to develop, implement, and train employee(s) on a COVID-19 Prevention Program that includes, at a minimum, the following protocols:
