29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  On or about October 1, 2020, and at times prior thereto, at a commercial construction jobsite, employees were exposed to overhead struck-by hazards from employees working above with hand tools.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  On or about October 1, 2020, two employees installing insulation support from a window opening of a commercial construction project were not protected from falling. The employees were exposed to unprotected fall hazards of 24 feet or more to the ground below.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  On or about October 1, 2020, and at times prior thereto, at a commercial construction job site, two employees performing insulation work climbed an extension ladder to access and egress the upper work area with the ladder not extended at least 3 feet above the upper landing surface exposing the employees to fall hazards of up to 24 feet.
