29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated 1926.502(e).  On or about October 2, 2020, employees were performing framing operations outside a residential property using a JLG 450 AJ aerial lift and were exposed to fall hazards of 16 feet, 6 inches feet when the employer failed to ensure that fall protection was utilized.     No abatement certification or documentation is required for this item.

29 CFR 1926.454(a)(1): The employer failed to have each employee who performs work while on a scaffold trained regarding the nature of any electrical hazards, fall hazards and falling object hazards in the work area.  On or about October 2, 2020, the employer did not ensure that employees were trained to recognize and minimize hazards associated with falls while operating aerial lifts.  Two employees were performing framing operations outside a residential property using a JLG 450 AJ aerial boom lift at a residential property and were exposed to fall hazards of 11 feet, 6 inches when they failed to utilize fall protection.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
