29 CFR 1926.754(e)(2)(iii): Metal decking holes and openings were cut and not immediately covered or permanently filled with the equipment or structure needed to fulfill its specific use which meets the strength requirements of paragraph (e)(3) of this section. (a) Valley View Elementary: On or about September 25, 2020, and at times prior thereto, the controlling contractor, Beniton Construction, Inc. did not ensure its sub-contractor protected its employees while performing structural steel activities on the metal deck. Four open penetrations were not covered and/or permanently filled, exposing the sub-contracted employees to trip and/or fall hazards to a concrete floor below.
