The Employer did not provide the Occupational Safety and Health Administration (OSHA) certification of abatement as required for Citation #1, Items #1 & #2 issued on November 3, 2020.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   At jobsite located at 1701-1810 N Newberry Circle Derby KS, employees engaged in residential framing activities were exposed to fall hazards of approximately 21.5 feet from the roof to the ground in that fall protection was not utilized.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At jobsite located at 1701-1810 N Newberry Circle Derby KS, employees engaged in residential framing activities were exposed to falls from 21.5 feet, in that the aluminum ladder used to access the roof did not extend 3 feet from the eave of the roof.
