29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about October 2, 2020 and at times prior thereto, the employer failed to ensure employees were wearing safety glasses while operating nail guns when performing framing activity exposing the employees to eye hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about October 2, 2020 and at times prior thereto, employees working on the top of the third floor of an apartment complex performing framing activity had no fall protection and were exposed to a fall hazard of approximately 30 feet to the ground below.  The (Soldevilla Construction) was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(1), which was contained in OSHA inspection number 1370566, citation number 1,  item number 1 and was affirmed as a final order on May 13, 2019, with respect to a workplace located at 5601 Golden Triangle, Fort Worth, Texas 76244.

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.   On or about October 2, 2020 and at times prior thereto, the employer failed to verify fall protection training to his employees while performing framing activity, exposing employees to fall hazards.
