29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that; employees were exposed to struck-by and crushing hazards: On or about October 1, 2020, and at times prior, pieces of wood were used to push the contents from Vestil D style-dumping hoppers, that were elevated on the forks of powered industrial trucks, because the forklifts were lacking serviceable security pull cables, thereby; exposing employees to struck-by, crushing, and amputation hazards. Recommended Abatement Action: Among other methods, feasible means of abatement would be to ensure all self dumping hoppers are properly secured to powered industrial trucks; all safety devices on self dumping hoppers maintained in serviceable conditions; and operators for this type of equipment trained on its proper use.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: On or about October 1, 2020 and at times prior, employees were exposed to struck-by and crushing hazards, in that; powered industrial trucks were operating without the manufacturers written approval and marking prior to using Vestil D self dumping hoppers on forklifts.

29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. On or about October 1, 2020 and at times prior, employees are exposed to a struck-by and crushing hazards when dismounting forklifts with Vestil D self dumping hoppers on forks and in an elevated position over dumpsters.
