29 CFR 1926.20(b)(2):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On October 7, 2020 at 2223 E Bald Eagle Drive in Appleton, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized fall from elevation hazards associated with employees using the top of a stepladder as a step and using an extension ladder to access a roof without the side rails extended at least three feet above the roof, struck-by hazard associated with an employee operating a power saw without utilizing safety glasses, and slip/trip hazards associated with an employee walking on/standing on board scraps in a work area.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures.  On October 7, 2020 at 2223 E Bald Eagle Drive in Appleton, Wisconsin, an employee was operating a powered, circular saw cutting roofing materials with slip and trip hazards in the work area; scrap pieces of two by four (2x4) and Oriented Strand Board (OSB) piled on the walking/working surface around all sides of cutting table, an air hose, and plastic wrap.

On October 7, 2020 at 2223 E Bald Eagle Drive in Appleton, Wisconsin, an employee was operating a handheld, powered DeWalt circular saw without utilizing safety glasses; employee cutting roofing materials.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On October 7, 2020 at 2223 E Bald Eagle Drive in Appleton, Wisconsin, employees were using an extension ladder to access/egress a roof surface twelve feet above surface level without the side rails extended at least three feet above the eave edge; side rails were extended twenty inches above the roof surface.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a)  On October 7, 2020 at 2223 E Bald Eagle Drive in Appleton, Wisconsin, employees were working from a roof surface installing roof sheathing twelve feet above surface level without utilizing fall protection equipment.  b)  On October 7, 2020 at 2223 E Bald Eagle Drive in Appleton, Wisconsin, employees were walking on the bottom chords of trusses installing roof sheathing nine feet above surface level without utilizing fall protection equipment.

29 CFR 1926.503(a)(2)(iii):  The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On October 7, 2020 at 2223 E Bald Eagle Drive in Appleton, Wisconsin, the employer did not provide require fall protection safety training for employees who were exposed to fall from elevation hazards while installing roof sheathing at heights greater than six feet.
