29 CFR 1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. On or about October 7, 2020, and at times prior thereto, on the East side of a newly built commercial building, where employees were exposed to a fall hazard when performing masonry activities from fabricated frame scaffolding without a ladder or other safe means of access. VILLEGAS MASONRY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.451(e)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1336759, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 30, 2018, WITH A FINAL ABATEMENT DATE OF AUGUST 31, 2018, WITH RESPECT TO A WORKPLACE LOCATED AT 11690 SPRING CYPRESS ROAD, TOMBALL, TEXAS 77377. On or about October 15, 2020, on the East side of a newly constructed commercial building, where employees were exposed to a fall hazard exceeding 10 feet when applying stucco material from the second level of a fabricated frame scaffold without a guardrail system or fall protection system in place.
