29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a.) On or about October 8, 2020, the employer did not ensure the Nissan 50 forklift was taken out of service after being found to be in need of repair. Employees use the Nissan sit down liquid propane forklift to load and unload trucks at the facility and were exposed to potential fire hazards after the forklift was used after being marked "engine won't start".
