Employees were working from a supported scaffold, employees were working on the upper levels of the scaffold with tools and materials that could have fallen and the employer did not ensure that the employees on the lower levels were wearing protective helmets.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about October 9, 2020, employees were exposed to a fall of approximately 19 feet while performing masonry activity on a new residential home located at SL 10 Deer Hollow, Valley City, Ohio 44280. Employees were working from a supported scaffold and the employer did not ensure that they had a safe access point.
