OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:  a) Davis Ventures, LLC dba Four Corner Furniture, Bozeman MT: On or about October 6, 2020, and at times prior, employees were exposed to struck by hazards while using 1/2" polyvinyl chloride (PVC) tubing to transfer compressed air.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a) Davis Ventures, LLC dba Four Corner Furniture: On  or about October 6, 2020, and at times prior, employees were exposed to struck by hazards while operating  the Turbo CAT 236B (CAT0236BVHEN01591), with an unapproved hole in the forklift fork used to mount a trailer ball to move trailers.
