29 CFR  1926.20(b)(1):  Acccident prevention responsibilities.  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about October 13, 2020, at the 161 Balderson Drive, Pickerington, Ohio worksite;  the employer failed to initiate a safety and health program, such as  but not limited to a fall protection program to comply with 29 CFR 1926.501(b)(13) for workers performing framing carpentry during residential single family home construction from elevated heights.  Due to this lack of program, framing carpenters were unprotected from falling while constructing a single family home at this worksite.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about October 13, 2020, at the 161 Balderson Drive, Pickerington, Ohio worksite;  the employer had not performed any safety training or other instruction for carpentry workers in the avoidance of unsafe conditions and the elimination of hazards in framing carpentry construction, such as but not limited to the avoidance and elimination of fall hazards.  The employer did not have a safety training program for workers performing framing construction from heights related to fall protection.

29 CFR  1926.503(a)(1): "Training Program." The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. On or about October 13, 2020, at the 161 Balderson Drive, Pickerington, Ohio worksite;  the employer had not performed training and had not provided a fall protection training program for framing carpentry workers. Framing carperntry workers had not been trained in the information contained by 29 CFR 1926.503 (a)(2)(i) - (viii) and training had not been certified as required by 29 CFR 1926.503 (b)(1). Due to this condition, employees were exposed to fall hazards of approximately ten feet while constructing attached garage wall framing from atop the wall without fall protection.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about October 13, 2020, at the 161 Balderson Drive, Pickerington, Ohio worksite;  the employer failed to provide, require and assure the use of fall protection during construction work performed on a single family residential building. A personal fall arrest system was not used, safety net system was not used and a guardrail system was not used. Due to this condition, a framing carpenter worked unprotected from falling  approximately ten feet while seated atop the first story framing wall of the attached garage.
