Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Cruz & Sons General Construction, LLC , at a jobsite located at 7125 Sea Breeze West, Building 6, Sunbury, Ohio 43074: On and/or preceding October 14, 2020, the employer did not ensure employees were protected from falls while engaged in residential framing activities. Employees were working while standing on the top plate of the walls while exposed to fall hazards of up to 20 feet  Jorge Cruz was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1284747, citation number 2, item number 1 and was affirmed as a final order on February 20, 2018, with respect to a workplace located at 10818 Arrowwood Drive, Plain City, OH 43064  Jorge Cruz was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1261839, citation number 1, item number 1 and was affirmed as a final order on October 30, 2017, with respect to a workplace located at 2182 Koester Trace, Lewis Center, OH 43035

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a) Cruz & Sons General Construction, LLC , at a jobsite located at 7125 Sea Breeze West, Building 6, Sunbury, Ohio 43074: On and/or preceding October 14, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program and a fall protection program for employees conducting framing work.  Jorge Cruz was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1284747, citation number 1, item number 1 and was affirmed as a final order on February 20, 2018, with respect to a workplace located at  10818 Arrowwood Drive, Plain City, OH 43064

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Cruz & Sons General Construction, LLC , at a jobsite located at 7125 Sea Breeze West, Building 6, Sunbury, Ohio 43074: On and/or preceding October 14, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were not utilizing eye protection while using pneumatic nail guns, which exposed them to struck-by hazards to the eyes.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Cruz & Sons General Construction, LLC , at a jobsite located at 7125 Sea Breeze West, Building 6, Sunbury, Ohio 43074: On and/or preceding October 14, 2020, the employer did not ensure employees were trained on the recognition of fall hazards or the procedures required to be followed to minimize the fall hazards. Employees, without fall protection training, were conducting framing activities while working on the third story of an apartment building, thereby exposed to fall hazards of up to 20 feet.  Jorge Cruz was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1284747, citation number 1, item number 2 and was affirmed as a final order on February 20, 2018, with respect to a workplace located at 10818 Arrowwood Drive, Plain City, OH 43064
