On or about October 14, 2020, located at 4150 Pyke Drive, Lot#7133, Powell, Ohio:  the employer did not initiate and maintain an effective safety and health program to ensure hazard detection and correction, while employees installed framing lumber on top of the exterior wall of the second floor level at the worksite exposed to fall and struck by harzards.

On or about October 14, 2020, located at 4150 Pyke Drive, Lot#7133, Powell, Ohio:  The employer failed to instruct an employee on the avoidance of unsafe conditions while they installed framing lumber on the exterior wall of the second floor level of a new build residential home.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a.  On or about October 14, 2020, located at 4150 Pyke Drive, Lot#7133, Powell, Ohio:  the employer failed to ensure that two employees were protected from flying debris to their eyes, when they operated the pneumatic nail gun to install framing lumber.  The employees were therefore exposed to struck-by hazards as a result.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a.  On or about October 14, 2020, located at 4150 Pyke Drive, Lot#7133, Powell, Ohio:  the employer failed to ensure that two employees who worked on top of the exterior wall of the second floor level of a new build residential home, were protected from falling to the ground level.  The employees were exposed to a fall distance of approximately 18 feet to the ground level.
