29 CFR 1910.147(c)(4)(i):Procedures were not utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: On or about September 28, 2020, the employer failed to ensure employees changing parts on a Birmingham Press Brake, model number VH-410-6, serial number 3559, were protected by utilizing written lockout/tagout procedures. The employee cycled the machine while removing a die and three [3] fingertips were amputated.

1910.212(a)(3)(ii): The point of operation of machines whose operation exposed an employee to injury, was not guarded: On or about September 28, 2020, the employer failed to ensure employees operating a Birmingham Press Brake, model number VH-410-6, serial number 3559, were protected from contact with the pinch points in that, the machine has a one button control and/or foot pedals for operation with no machine guarding in place.
