29 CFR 1926.102(a)(2): The employer did not ensure that each affected employee used eye protection that provided side protection when there is a hazard from flying objects: On or about October 15, 2020, and at times prior thereto, workers were exposed to a struck-by flying projectile hazard, while using a Makita Circular Saw and Pneumatic Nail Guns without safety glasses.

29 CFR 1926.501(b)(2)(i): Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: East side of the commercial construction site: On or about October 15, 2020, and at times prior thereto, workers without fall protection were exposed to a fall hazard greater than 6 feet to the unpaved ground below while installing plywood from a leading edge.
