29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  (a) On October 16, 2020, employees conducting painting and EFIS work on the exterior of a commercial building, did not utilize an acceptable means for egress and access to the scaffold platform. Employees utilized/climbed the scaffold frame and cross brace structures for access/egress, exposing employees to a fall hazard greater than 25 feet from the lower level.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  (a) On October 16, 2020, employees conducting painting and EFIS work on the exterior of a commercial building on a fabricated scaffold system and were not trained on the safe use of scaffolding by a qualified person.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  (a) On October 16, 2020, employees conducting painting and EFIS work on the exterior of a commercial building were not protected by a fall protection system on the ends of the scaffold platform. This exposed employees to a fall hazard greater than 25 feet to the lower level.
