29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about October 15, 2020, and at times prior thereto, three employees were laying brick on the commercial project under construction working from a three tier tubular welded scaffold that did not have a ladder for access, exposing the employees to a fall hazard.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  On or about October 15, 2020, and at times prior thereto, three employees were laying brick on the commercial project under construction working from a three tier tubular welded scaffold that did not have guardrails installed on all open sides and ends of platforms, exposing the employees to a fall hazard.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a)  Any electrical hazards, fall hazards and falling object hazards in the work area; b)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c)  The proper use of the scaffold, and the proper handling of materials on the scaffold; d)  The maximum intended load and load-carrying capacities of the scaffolds used; and e)  Any other pertinent requirements of this subpart.  On or about October 15, 2020, three employees were laying brick to the commercial project under construction working from a three tier tubular welded scaffold without being trained to recognize the hazards of working from scaffolding, exposing employees to a fall hazard.
