29 CFR  1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes.    On or about October 13, 2020, at an oil and gas well pad, the employer did not require an employee to use fire resistant hand protection when working at a produced water tank where a contract welder used an oxygen acetylene torch.  This exposed employees to fire hazards.

29 CFR  1910.252(a)(2)(iv): The individual responsible for authorizing cutting or welding operations did not designate precautions to be followed in granting authorization to proceed preferably in the form of a written permit.   On or about October 13, 2020, at an oil and gas well pad, the employer did not designate precautions to be followed which include, but are not limited to air testing the tank interior for flammable atmospheres, prior to allowing a contract welder to use an oxygen acetylene torch on the exterior of a produced water tank while an employee steamed the tank.  This exposed the employees to fire hazards.

29 CFR  1910.252(a)(3)(i):  Welding, cutting, or other hot work was performed on used drums, barrels, tanks, or other containers that had not been cleaned so thoroughly as to make absolutely certain there were no flammable materials present or any substances such as greases, tars, acids, or other materials which where subjected to heat, might produce flammable or toxic vapors.  On or about October 13, 2020, at an oil and gas well pad, a  produced water tank was not cleaned so thoroughly as to make absolutely certain there were no flammable materials or any substances, when subjected to heat produce flammable vapors, were present.  A contract welder used an oxygen acetylene torch at an exterior surface of the produced water tank and exposed employees to fire hazards.

On or about October 13, 2020, for work at an oil and gas well pad, the employer did not develop and implement at the workplace a written hazard communication program that described how criteria specified at 29 CFR 1910.1200(f), (g), and (h) would be met.  At an oil and gas produced water tank, where a pressure washer/steamer and oxygen acetylene torch were used, employees were exposed to hazardous chemicals including, but not limited to, crude oil (flammable) in produced water, Compressed oxygen (oxidizer), Acetylene (flammable), Gasoline (flammable), and Diesel (flammable).
