29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   East side of the commercial construction site: On or about October 15, 2020, and at times prior thereto, the employer did not provide a ladder for access and egress from a mobile scaffold.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:  West side of the commercial construction site: On or about October 15, 2020, and at times prior thereto, employees were exposed to a fall hazard, while installing joists from a mobile scaffold that was not fully planked.

29 CFR 1926.501(b)(2)(i): Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:   East side of the commercial construction site: On or about October 15, 2020, and at times prior thereto, employees without fall protection were exposed to a fall hazard greater than 6 feet to the unpaved ground below while installing plywood from a leading edge.
