29 CFR  1903.19(c)(1):Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The Employer did not provide the Occupational Safety and Health Administration (OSHA) certification of abatement as required for Citation #1, Item #2 issued December 29, 2020.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  At jobsite 8023-8025 34th Ct Wichita KS, employee engaged in ground hand activities working below employee engaged in framing activities were exposed to struck-by hazards in that head protection was not provided.  Rafael Abarca-Barragan was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 1463205, citation number 1, item number 1 and was affirmed as a final order on 03/30/2020, with respect to a workplace located at 3519 S. Lori Wichita Kansas 67210  29 CFR 1903.19(c)(2) abatement of the above violation was verified at time of inspection, no certification is required.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  At jobsite 8023-8025 34th Ct Wichita KS, employees engaged in residential framing activities using a Paslode pneumatic nailer were exposed to struck-by hazards in that eye protection was not provided.  Rafael Abarca-Barragan was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1463205, citation number 1, item number 2 and was affirmed as a final order on 03/30/2020, with respect to a workplace located at 3519 S. Lori Wichita Kansas 67210.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  At jobsite 8023-8025 34th Ct Wichita KS, employees engaged in residential framing activities were exposed to fall hazards of approximately 10 feet from the roof to the ground in that fall protection was not utilized.  Rafael Abarca-Barragan was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1463205, citation number 1, item number 4 and was affirmed as a final order on 03/30/2020, with respect to a workplace located at 3519 S. Lori Wichita Kansas 67210.  29 CFR 1903.19(c)(2) abatement of the above violation was verified at time of inspection, no certification is required.
