NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR  1910.107(c)(9)(i): All metal parts of spray booths, exhaust ducts, and piping systems conveying flammable liquids or liquids with a flashpoint greater than 199.4 �F (93 �C) or aerated solids were not properly electrically grounded in an effective and permanent manner.    a) Spray booth: The hose used to convey  3M 94 CA Postforming Adhesive (Class II flammable) to a spray gun  was not grounded, on or about 10/20/2020.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization as a result of a work-related incident to OSHA within twenty-four (24) hours.   a) Facility: On or about 10/5/2020, an employee was hospitalized after falling from a loading dock resulting in a severe head lacerations and sprains to the lower back. The employer did not report the hospitalization of that employee to OSHA within 24 hours.
