OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that forklifts were operated without seat belts being used or in place. This condition exposed employees to struck-by/crushing hazards. a) On or about 10/14/2020, in the dock area and warehouse, forklifts were operated without seat belts. It was observed that a green Clark forklift, model number ECX30, had a broken seat belt buckle. Employees operated the forklift in its condition and other forklifts on site without wearing seat belts. b) On or about 10/14/2020, outside at the propane storage area, a yellow Clark forklift, model number CGP55, was missing a seat belt. The forklift was in service and operated by management to install racking.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: a) On or about 10/14/2020, in the dock area and warehouse, forklifts were operated with damage to their overhead cages. It was observed that the overhead cage for a green Clark ECX30 was damaged in that its overhead cage had been cut through compromising its structural integrity.
