29 CFR  1926.300(b)(1): Power operated tools designed to accommodate guards, were not equipped with such guards when in use.  a) At the worksite, 12 McNally St, Goshen, N.Y.., Employees were working in close proximity to the rotating parts of a Bush Hog Post Hole Digger attachment, Model #2101.  An employee's clothing was caught by the exposed driveline and pulled into and around it. The employee suffered fatal injuries. The employer did not ensure the guard between the U-joint and the gearbox on the driveline, and the guard below the gearbox on the auger were in-place while the equipment was in operation, on or about October 19. 2020.

The employer did not ensure the employees remained a safe distance from the driveline while in operation, on or about October 19, 2020.
