29 CFR  1910.28(b)(8): The employer did not guard the service pit as required or: (A) Limit access within 6 feet (1.8 m) of the edge of the pit to authorized employees trained in accordance with � 1910.30; (B) Applies floor markings at least 6 feet (1.8 m) from the edge of the pit in colors that contrast with the surrounding area; or places a warning line at least 6 feet (1.8 m) from the edge of the pit as well as stanchions that are capable of resisting, without tipping over, a force of at least 16 pounds (71 N) applied horizontally against the stanchion at a height of 30 inches (76 cm); or places a combination of floor markings and warning lines at least 6 feet (1.8 m) from the edge of the pit. When two or more pits in a common area are not more than 15 feet (4.5m) apart, the employer may comply by placing contrasting floor markings at least 6 feet (1.8 m) from the pit edge around the entire area of the pits; and (C) Posts readily visible caution signs that meet the requirements of � 1910.145 and state "Caution-Open Pit:"  (a)N.T.A. Ltd. at 1001 4th Street North West, Huron, SD 57350:  On or about and at times prior to October 16, 2020, the employer did not ensure employees were protected from falling into an open service pit. The employer did not apply floor markings or place a warning line at least six feet from the edge and post readily visible caution signs identifying the fall hazard into the open service pit. This condition exposed employees to fall hazards greater than four feet in depth. 29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  (a)N.T.A. Ltd. at 1001 4th Street North West, Huron, SD 57350:  On or about and at times prior to October 16, 2020, the employer did not ensure employees working in the wash bay  using MC-1 which is a corrosive, to clean aluminum equipment were provided suitable facilities for quick drenching or flushing of the eyes and body within the work area for immediate emergency use. This condition exposed employees to eye injuries.   Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)N.T.A. Ltd. at 1001 4th Street North West, Huron, SD 57350:  On or about and at times prior to October 16, 2020, the employer did not ensure all forklift operators were trained in operation of powered industrial trucks in that the operators were not trained in the use of the Toyota forklift prior to their use.  This condition exposed the employees to the hazard of improper forklift operation.  Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a)N.T.A. Ltd at 1001 4th Street North West, Huron, SD 57350:  On or about and at times prior to October 16, 2020, the employer had not develop and implement a written hazard communication program which at least included the  criteria specified for labels and other forms of warning, safety data sheets, and how employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks.  Employees used the following hazardous chemicals:  (1)  MC-1 Aluminum cleaner; (2)  brake cleaner; (3) anti-freeze; (4) refrigerants  Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR  1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment:     (a)N.T.A. Ltd. at 1001 4th Street North West, Huron, SD 57350:  On or about and at times prior to October 16, 2020, the employer did not assess the workplace to determine what hazards were present and select and require the use of appropriate personal protective equipment.  The employer did not determine what forms of personal protective equipment were needed regarding the parts cleaner,  use of corrosives to clean aluminum equipment, and exposure to chemicals as a part of the maintenance of tractors and trailers. This condition exposed the employees to chemical hazards.  Abatement Note:  When then employer has determined that hazards are present, or likely to be present, the employer shall:  (1)	Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  (2)	Communicate selection decisions to each affected employee; and,  (3)	Select PPE that properly fits each affected employee.  (4)	The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  (5)	Defective and damaged equipment. Defective or damaged personal protective equipment shall not be used.  (6)	The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the following:  (a)	When PPE is necessary;  (b)	How to properly don, doff, adjust, and wear PPE;  (c)	The limitations of the PPE; and,  (7)	Each affected employee shall demonstrate an understanding of the training specified in paragraph (1) of this section, and the ability to use PPE properly, before being allowed to perform work requiring the use of PPE.  (8)	When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (2) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:  (a)	Changes in the workplace render previous training obsolete; or  (b)	Changes in the types of PPE to be used render previous training obsolete; or  (c)	Inadequacies in an affected employee's knowledge or use of assigned PPE indicate that the employee has not retained the requisite understanding or skill.  (9)	The employer shall verify that each affected employee has received and understood the required training through a written certification that contains the name of each employee trained, the date(s) of training, and that identifies the subject of the certification.  (10)	Paragraphs (d) and (f) of this section apply only to 1910.133, 1910.135, 1910.136, and 1910.138. Paragraphs (d) and (f) of this section do not apply to 1910.134 and 1910.137.  Note: Non-mandatory Appendix B contains an example of procedures that would comply with the requirement for a hazard assessment.
