29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 2744 Arlee Ave, Lot 139 Village at Waterford, Opelika, Alabama:  On or about October 22, 2020 and at times prior; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of 9.2 feet to the ground below.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:     a)  At 2744 Arlee Ave, Lot 139 Village at Waterford, Opelika, Alabama:  On or about October 22, 2020 and at times prior; the employer and his employees used the top step of a six foot a-frame ladder to gain access to the top of the floor joist to perform framing activities exposing the employer and his employee to a fall hazard of 9.2 feet to the ground below.
