29 CFR 1910.178(l)(5): The employer did not evaluate the competency of the operator who had previously received training appropriate to the truck and working conditions encountered. a) Warehouse - On or about October 5, 2020, the employer did not ensure that an employee who operated a 2020 Hyster Forklift, S/N B267V03488U, and had previously been trained to operate other powered industrial vehicles (PIVs) was evaluated prior to being allowed to operate the forklift to ensure the employee could safely operate the forklift in the workplace, thereby exposing the employees to struck-by hazards.
