29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard:  a. On or about October 9, 2020, at 1245 Mill Creek Rd, Bradenton, FL 34212, employees were exposed fall hazards while climbing on trees and while in an aerial basket, in that, training and education on fall protection was not provided. The employees were required to use fall protection but training on the limitations and proper use of fall protection was not provided.

On or about October 9, 2020, at 1245 Mill Creek Rd, Bradenton, FL 34212, employees were exposed to the hazard of operating a vehicle mounted aerial lift without proper training and education. The employees were given instructions on the controls and how to set the outriggers, however, employees were not provided with instructions and precautions on how to safely operate around trees and around overhead power lines.

On or about October 9, 2020, at 1245 Mill Creek Rd, Bradenton, FL 34212, employees were exposed to overhead power lines powered to 13,200 volts during tree trimming and clearing, in that, while in an elevated non-insulated vehicle mounted platform contact was made with the power line causing serious injuries to an employee. Training and education was not provided relating to the hazards of working near overhead power lines.

On or about October 9, 2020, at 1245 Mill Creek Rd, Bradenton, FL 34212, employees were exposed to overhead power lines powered to 13,200 volts during tree trimming and clearing, in that, the lines were not insulated or deenergized nor was protective gear such as, but not limited to, insulating gloves were provided while in a non-insulated elevated vehicle mounted platform during tree trimming and clearing near overhead power lines.

29 CFR  1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:  a. On or about 9:04 AM on October 9, 2020, at 1245 Mill Creek Rd, Bradenton, FL, 34212, an employee suffered a work related injury and was hospitalized on the same day of the incident. The employer was aware of the in-patient hospitalization at around 12:00 PM of October 9, 2020. The employer notified OSHA on October 13, 2020 at 8:25 AM of the in-patient hospitalization.
