29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: Worksite, 49 Rutherford St., Newark, NJ a) The employer did not ensure that a competent person made inspections of protective systems prior to employee entry into an excavation approximately 12 feet deep to install and tie sewer pipe to a sanitary sewer concrete riser labeled #2 . The timber shoring used to protect employees in this trench was not adequate. b) The employer did not ensure that a competent person made inspections of protective systems prior to employee entry into an excavation approximately 15 feet deep to install and tie sewer pipe. The timber shoring intended for use to protect employees in this trench was not adequate. Violation occurred on or about 10-16-2020 to 10-23-2020

29 CFR 1926.652(c)(1): Designs for timber shoring in trenches were not determined in accordance with the conditions and requirements set forth in appendices A and C to this subpart.: Worksite, 49 Rutherford St., Newark, NJ a) The employer did not ensure that the timber shoring used to protect employees in the sewer riser #2 trench approximately 12 feet deep was adequate. The employer used 4 x 10 oak timber only, when 6 x 6 cross braces and 8 x 8 wales were required by Appendix C Table C 1.2. b) The employer did not ensure that the timber shoring used to protect employees in the 15 feet deep trench was adequate. The employer used 4 x 10 oak timber only, when 6 x 6 cross braces and 8 x 8 wales were required by Appendix C Table C 1.2. Violation occurred on or about 10-16-2020 to 10-23-2020
