29 CFR  1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  a) 1350 W, West Interstate 65 Service Rd S. Woodspring Suites; On or about October 26, 2020 and at times prior to the employer exposed employees to fall hazards in that the employer required that employees use a boom lift to access the roof of a hotel that was forty feet in height without requiring the use of a body belt exposing the employees to fall hazards.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) 1350 W, West Interstate 65 Service Rd S. Woodspring Suites; On or about October 26, 2020 and at times prior to the employer exposed employees to fall hazards in that the employer required that employees work on a roof of a four story hotel that was 40 feet in height with a 5/12 pitch removing and replacing damaged shingles and did not enforce the use of fall protection exposing the employees to fall hazards.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) 1350 W, West Interstate 65 Service Rd S. Woodspring Suites; On or about October 26, 2020 and at times prior to the employer exposed employees to fall hazards in that the employer required that employees work at heights of greater than 6 feet without first certifying that employees had been training on fall protection and the recognition of fall hazards exposing the employees to fall hazards.
