29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedures and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4): a. Production Area - On or about October 16, 2020, the employer did not ensure an energy control program consisting of an energy control procedure, employee training and periodic inspections was established for employees performing service and maintenance on machines including, but not limited to, Press Brakes #7, #8, #19 and Hydra Power Press Brake. The employees were thereby exposed to hazards associated with rotating and moving parts.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a. Production Area - On or about October 16, 2020, the employer failed to provide effective guarding to protect employees working at or near the Di-acro Hydra Power Press Brake, Model #55-6, Serial # 655087620. An employee's right hand index finger was amputated while in the danger zone during the bending process. b. Production Area - On or about October 26, 2020, the employer failed to provide effective guarding to protect employees working at or near Press Brake #7. Employees were thereby exposed to the hazards associated with unguarded points of operation during the operating cycles. c. Production Area - On or about October 26, 2020, the employer failed to provide effective guarding to protect employees working at or near Press Brake #8. Employees were thereby exposed to the hazards associated with unguarded points of operation during the operating cycles. d. Production Area - On or about October 26, 2020, the employer failed to provide effective guarding to protect employees working at or near Press Brake #19. Employees were thereby exposed to the hazards associated with unguarded points of operation during the operating cycles.
