29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  New residential construction located on Lot #86, Second floor: On or about 10/27/2020, while engaged in framing activities, employee operating pneumatic framing nail guns set at 120 PSI were exposed to  struck-by hazards from flying plastic collated debris and fastener in that protective eyewear was not provided for employee use.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   New residential construction located on Lot #86, Second floor: On or about 10/27/2020, the employer exposed employees to fall hazards of approximately 11-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in sheathing and framing activities.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   New residential construction located on Lot #86, First floor stairwell: On or about 10/27/2020, the employer exposed employees to fall hazards of approximately 10-feet, 4-inches to the lower concrete slab, in that a ladder extending at least 3-feet past the landing was not provided to employees accessing the upper and lower levels of the structure.

29 CFR  1926.1053(b)(13): The top or top step of a stepladder was used as a step:(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)    New residential construction located on Lot #86, First floor stairwell: On or about 10/27/2020, the employer exposed employees to fall hazards of approximately 7-feet, 6-inches to the lower concrete slab, in that a ladder used to access the upper level was a step ladder in which employees used the top rung/step and the top cap of the ladder to access the upper level.
