29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: At site 112 W. 2nd Haven Kansas, employees engaged in maintenance activities were exposed to struck-by and crushing hazards in that the employer did not ensure that appropriate permission from the manufacturer was obtained by the user prior to using an attachment on the Caterpillar Forklift, and did not ensure that markings for the capacity, operation and maintenance were changed accordingly. 29 CFR 1903.19(c)(2) abatement of the above violation was verified at time of inspection, no certification is required.

29 CFR 1910.272(k): Receiving pit feed openings in the grain handling facility, such as truck or railcar receiving pits, were not covered by grates which had a maximum opening width of 2.5 inches: At Elevator Two, employees emptied product from railcars and trucks into the receiving pit area, receiving pit contained an opening that measured 3 inches exposing employees to explosion hazards. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
