29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a.  On or about October 27, 2020, and at times prior, on the job site of the U.S. Highway 301 Alligator Creek Bridge construction project in Starke, Florida, the employer had not developed a written respiratory protection program for employees who were required to wear elastomeric half face piece respirators with particle filter cartridges while cutting concrete pipe containing respirable crystalline silica.

On or about October 27, 2020, and at times prior, at the job site of the U.S. Highway 301 Alligator Creek Bridge Construction project in Starke, Florida, the employer had not provided medical evaluations for employees who were required to wear elastomeric half face piece respirators with particle cartridge filters while cutting concrete pipe containing respirable crystalline silica.

On or about October 27, 2020, and at times prior, at the job site of the U.S. Highway 301 Alligator Bridge construction project in Starke, Florida, the employer had not provided fit testing for employees that were required to wear tight fitting elastomeric half face respirators with particle filter cartridges while cutting concrete pipe containing respirable crystalline silica.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a.   On or about October 27, 2020, and at times prior, at the job site of the U.S. Highway 301 Alligator Creek Bridge construction project in Starke, Florida, the employer did not fully implement engineering controls, work practices, and respiratory protection for employees cutting concrete pipe containing respirable crystalline silica.
